1. THE "BRING YOUR OWN KEY" (BYOK) MODEL & FINANCIAL LIABILITY

1.1 Nature of Service: LOMO v2 ("The Software") is a client-side interface that allows you to interact with third-party Artificial Intelligence models (specifically Google Gemini). The Software does not contain AI models; it requires a valid API Key ("Key") to function.

1.2 User Financial Responsibility: You acknowledge that you are solely responsible for obtaining and maintaining your own API Key from Google. You are solely responsible for all billing, usage fees, and overage charges incurred on your Google Cloud Platform account.

1.3 No Affiliation: The Software is an independent tool and is not affiliated with, endorsed by, or sponsored by Google LLC.

1.4 Pricing Changes: We are not liable if Google changes their API pricing, removes their Free Tier, or alters their billing structure. Your purchase of The Software covers the interface license only, not the AI generation costs.

2. LIFETIME LICENSE DEFINITION

2.1 Scope: The term "Lifetime License" refers to the lifetime of the Software version, not the lifetime of the purchaser or the developer.

2.2 Third-Party Dependency: The Software relies on the availability of Google's Gemini API (specifically the gemini-2.0-flash or similar endpoints). If Google deprecates, retires, or significantly changes these models, The Software may cease to function. In such an event, the "Lifetime" of the product is considered concluded. No refunds will be issued based on third-party API discontinuations.

3. COPYRIGHT & "INJECTOR MODE" LIABILITY

3.1 User Responsibility: The "Injector Mode" allows you to upload external images. You represent and warrant that you own the copyright to any image you upload or have explicit permission from the copyright holder to use it.

3.2 Prohibited Conduct: You explicitly agree NOT to use The Software to:

Remove watermarks from copyrighted stock images.
Inject logos into images of products, buildings, or persons for which you do not hold rights.
Create fraudulent marketing materials that misrepresent a commercial partnership (e.g., placing your logo on a Nike billboard without permission).

3.3 Indemnification: You agree to indemnify, defend, and hold harmless the developer of LOMO v2 from any claims, lawsuits, or damages arising from your violation of third-party copyrights or trademarks. If you get sued for using a stolen image, you agree that you are solely liable.

4. ACCEPTABLE USE & SAFETY

4.1 Deepfakes & Harm: You may not use The Software to generate non-consensual sexual imagery (NCII), hate speech, or photorealistic images of public figures for deceptive purposes.

4.2 Account Termination: We reserve the right to revoke your license key without refund if we discover you are using the tool for illegal or malicious activities.

5. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE OR THAT GOOGLE'S API WILL ALWAYS BE AVAILABLE.
